These terms and conditions of service together with any terms and policies referred to in them (Our Terms) constitute a legally binding agreement between you and Midrive Limited (referred to as “us”, “we”, “our” and “Midrive” as contextually required).
These terms and conditions cover users of the free Midrive Learner app – “Free App Users” – as well as those users who have additionally purchased driving lessons or other services from Midrive directly – “Full Service Users”.
The first section of the terms entitled “Terms For All Users” are applicable to both Free App Users and Full Service Users, while the section entitled “Terms For Full Service Users” includes additional terms relevant to Full Service Users.
Who are we?
We are a group of people committed to reinventing learner driving and insurance by using tech and data with a fresh attitude, to empower both learners and instructors.
Midrive is a platform to help driving instructors and learner drivers get connected, manage their lessons, and find money-saving offers on products such as insurance.
We also have to provide the boring answer:
Midrive.com and Midrive branded products are provided by Midrive Limited, company number 09134222, 131 Great Suffolk Street, London, SE1 1PP.
Please read the below terms and conditions (the “Terms”) carefully as they (together with the documents referred to) apply to both Free App Users and Full Learner App Users, your role as such, your use of Midrive and the services made available via Midrive.
Terms For All Users
Using our products and services
Midrive.com and any Midrive branded apps or sites (licensed or otherwise) are operated Midrive Limited (referred to as “us”, “we”, “our” and “Midrive” as contextually required). The terms and conditions outlined apply to the use of our website or app products (“services”).
By using any of our services you agree to comply with our terms and conditions. If you’re not happy to accept these terms or do not wish to be bound by them, you are not permitted to use any product or service provided by or branded as Midrive.
Apps and other products
You agree to use any of the Midrive branded apps for educational and/or consumer purposes only.
We are committed to making sure that Midrive, our products and services are secure and free from bugs or viruses, but we make no guarantee that this will be case.
You are responsible for ensuring that your information technology, computer, its programmes and platform are secure in order to access Midrive and our services. You should use your own virus protection software.
We assume no responsibility and shall not be liable for any loss or damage caused by a virus, or other technologically harmful material that may infect your computer or other equipment or other property on account of your access to, use of, or browsing of Midrive or any website linked to it.
Your data and information
Your personal data and information
When you sign-up to Midrive.com and other products you will need provide:
- Your name
- A valid email address
- A mobile number
Should you wish to proceed to purchase with us, you will then be required to provide us with more information:
- Your address
- Your availability
- Valid payment details
If you fail to provide us with a valid form of contact, we reserve the right to suspend or terminate your access to our platform and services. You are responsible for the confidentiality of your login details and any activities that occur on your account.
Should you believe that your account has been compromised, please contact us at email@example.com.
All of your information is kept secure and we comply with the relevant Data Protection laws applicable to our jurisdiction.
Content you provide
Some of our products allow you to provide content, such as an image for your Midrive learner profile or a review (collectively “Contributions”). When providing such content you acknowledge and agree that all contributions:
- Are accurate and genuine.
- Do not contain illegal or inappropriate material, language, content or context.
- Do not contain any personal or identifiable information.
The really important bit… how we use your data and information.
We will communicate with you via email, we accept no responsibility or liability if you provide an incorrect email address. Unfortunately, you are not able to use Midrive without a valid email address.
When you sign up to Midrive.com or any of our other products, you can opt in to agree to being contacted for marketing purposes.
Should you wish to be removed from receiving any of our marketing material, you can opt out any time within the Midrive Learner App >> My account >> Settings - Your data may be used to help improve our products and services.
Data and information provided by us
Our tech allows driving instructors to provide you with feedback and log your progress using the Midrive Instructor app.
In order to provide you with a lesson route we make use of location data sent from the Midrive Apps. You hereby consent to our transmission, collection, maintenance, processing and use of your location data and queries to provide and improve our location-based and road traffic-based products and services.
You also agree that we may collect and use technical information about your mobile device, system and related software, hardware and peripherals, gathered from time to time, to facilitate the provision of software updates, product support and improvements.
You accept that we offer no guarantee to lesson reports being provided, as lesson reports are subject to your instructor using the Midrive Instructor app and completing the lesson reports within the app.
Availability of Midrive.com and our products
We work hard to make sure that Midrive is available all of the time, but we make no guarantee or commitment to the service being available all of the time.
We reserve the right, where we believe necessary, to undertake all reasonable action to protect ourselves against fraud, suspicious or invalid redemptions, including but not limited to seeking further verification as to the identity of a customer.
Third party services
Midrive may, from time to time, present a selection of third party services which may include offers and promotions within the in-app marketplace or elsewhere.
These third party services may have their own terms and conditions of use and privacy policies. Your use of these third party services will be governed by and subject to such terms and conditions and privacy policies. You understand and agree that Midrive does not endorse and is not responsible or liable for the behaviour, features, or content of any third party services or for any transaction you may enter into with the provider of any such third party services.
Midrive reserves the right to withdraw third party services and offers at any time without providing notice.
Friend referral - Terms and Conditions
Our friend referral program is open to all app users.
By using this promotion and by providing us with any information in connection with this promotion, you are deemed to have accepted these terms and conditions and to be bound by them.
How to take part
In order to take part in the Midrive friend referral program, simply share your unique link with a friend or relative, who you think would benefit from learning to drive with Midrive. For every referral that results in a valid purchase (minimum purchase requirement applies), you will receive a cash credit.
Midrive reserves the right to amend the value of the cash credit and the operation of the friend referral scheme at any time without providing notice.
Promotion period and limitations
Our Friend referral program is valid from February 2017 and the promotion will continue until amended or revoked by us.
All products and services are subject to availability and there is no cash alternative should a service not be available in your local area.
Data and information you provide us and how we use it
We accept no responsibility or liability for any referrals that are lost or missed.
You agree not to share your unique referral code via a Search Engine (Google/Bing/Yahoo and alike) or with any third party promotions website. Sharing via social media pages including Facebook or Twitter is permitted.
We reserve the right to take such reasonable actions to protect ourselves against any fraudulent or invalid referrals, including, but not limited to requiring further information for a referrer or referee to provide more information to verify their identification.
We hope we don’t have to, but here are our terms on termination!
We reserve the right to suspend, restrict or terminate your access to Midrive and our services at any time without notice, if:
- You have breached our terms and conditions.
- You have committed an unlawful act towards us or a driving instructor.
- We suspect that you have fraudulently obtained or attempted to obtain services using Midrive.com, apps or any of our licenced services. Should we suspect such inappropriate and/or illegal use of our services, we reserve the right to report and/or bring legal action.
You are under no obligation to use Midrive or our services and may simply stop using them at any time.
The important legal bit…
All of our terms are governed by and construed in accordance with English law and subject to the exclusive jurisdiction of the English Courts.
You acknowledge that all intellectual property rights in Midrive (including but not limited to text, logos, design, layout, multimedia content, photos and graphics) and the Midrive Services, anywhere in the world, belong to us (or our licensors), that rights in Midrive are licensed (not sold) to you, and that you have no rights in, or to, Midrive other than the right to use it in accordance with these Terms.
Terms For Full Service Users
This section applies to learner drivers who have paid or are intending to pay Midrive directly for driving lessons, in our capacity as intermediary between learner and driving instructor.
Purchasing with Midrive
As part of Midrive, we offer a platform to introduce learner drivers and driving instructors, and to facilitate the payment of driving lessons to Instructors. Driving lessons can be purchased via Midrive.com, via the Midrive Learner App and the Midrive Theory App.
You agree to use Midrive.com and the Midrive branded apps in order to search lesson packages, make a purchase and be matched with a driving instructor. We reserved the right to control and restrict access to Midrive.com at any point, without any prior notice.
We work hard to ensure that Midrive.com is available all of the time, but we do not accept any liability, for any reason that our website or service is unavailable at any time or for any period.
You agree that you will use our service for lawful purposes only.
What we offer:
- A platform for Learners to search and buy driving lesson packages.
- To match learners with an Approved Driving Instructor.
- To facilitate payment between the Learner and Driving Instructors - payments are secure and processed through Stripe.
- We are not a driving school and we do not train nor employ any driving instructors.
Making a purchase with Midrive:
- You will need to provide and submit your personal details as well as valid payment details via Midrive.
- You must be the cardholder, or have express permission from the cardholder to use their details.
- You must provide current, complete and accurate information and ensure that any information is updated during your use of Midrive.
- To secure your booking, you will be required to pay a £25 deposit. The remaining balance is charged to the card provided once the first lesson is scheduled with your instructor.
Purchasing via Learner Theory app
We may at times offer an exclusive deal to our Theory app users, which can be purchased via our app. The taster lesson can only be purchased once. Any subsequent purchase(s) will be made at an increased rate. We reserve the right to withdraw this deal at any time and do not offer any guarantee to provide driving lessons if you fail to adhere to this clause.
A top up purchase is defined as any purchase of lesson hours made after your initial purchase.
You can top-up using the app or in the dashboard anywhere from 1 to 20 hours each time.
Top-up rates will, unless otherwise stated match the rates specified on Midrive.com for new customers. These rates are subject to change at any point without prior notice.
Practial Driving Test
Test day hire includes use of your instructor’s car for the duration of your driving test and travel to and from the test centre. It does not include the DVSA test fee. All test day hires must be discussed and agreed with your instructor prior to the test being booked.
All Midrive instructors may also ask to assess a learner before agreeing to take them to test. Midrive accepts no responsibility for the loss of any test day fee if you are deemed not ready for the test by your instructor.
When you agree to take a test with a Midrive instructor, you agree that they may charge any number of hours from your package to pay for the test day hire, and that the number of hours charged may not reflect the time spent with the instructor on the day.
You accept that you are responsible for providing correct and accurate test information to your instructor.
Driving instructors may increase their test day hire charge at any time, without prior notice. We do not accept any liability for a change in an instructors test day rates.
For short notice test day requests we require at least 5 working days notice. The Driver & Vehicle Standards Agency require 3 working days notice to cancel or reschedule your test.
We do not accept any liability for the loss of test fee or cancellation fee under any circumstances.
Payments made off the Midrive platform
There is no need to pay any money to your driving instructor directly if you have purchased through Midrive. If you pay your driving instructor directly in cash or via any other method, we do not accept any responsibility or liability for any driving lessons taken after that point. Your agreement with Midrive will cease and you will need to liaise directly with your driving instructor should any issue arise. Should your instructor ask you to pay him/her directly, please inform firstname.lastname@example.org as soon as possible.
Driving Lesson credits
All of the lesson credits (hours) you purchase with Midrive are valid for a period of 12 months from the date of purchase. Once credits become invalid, they and cannot be used to redeem for lessons or be refunded.
All credits are non-transferrable
It is your responsibility to review your account and ensure your lessons are correct (date and length of time). Any disputes regarding a lesson must be shared with us in writing no later than 3 months from the date the lesson occurred.
Driving lesson credits when purchased are valid for the location and transmission originally purchased at. Midrive reserves the right to charge the difference in price if a learner wishes to change either of these details. When calculating the price difference between automatic and manual, Midrive will calculate this based on pre discounted prices.
Complimentary lesson credits
We may from time to time issue complimentary lesson credits on a customer service basis. Any such credits will be issued at our discretion and can be withdrawn at any point.
These credits will be applied directly to your profile to use towards your driving lessons. If any refund is processed from your account, you will not be entitled to any credit amount in cash for any complimentary credits issued.
Your purchase and paperwork… well it’s all online!
All purchases with Midrive are done so online. We do not accept cash!
On successfully purchasing with Midrive you will receive an email confirmation - we do not offer or provide any printed versions.
Cancellations and refunds
All learners accept that they are responsible for ensuring the following:
- They have a valid UK Provisional Licence.
- They are able to present their UK Provisional Licence in their first driving lessons and any subsequent lessons, as directed by their instructor.
- They are of sound mind and ability to take driving lessons and are not:
- Under the influence of alcohol and/or a controlled substance.
- Recovering from excessive alcohol consumption.
Should you be deemed unfit for taking a driving lesson due to being under the influence of alcohol and/or a controlled substance or recovering from excessive alcohol consumption, you will be charged for your driving lesson and your instructor reserves the right to withdraw their services for providing driving lessons.
We reserve the right to refund any learner found to be in breach of our Terms and Conditions.
First lesson money back guarantee
If, after your first driving lesson with a new Midrive instructor you are not satisfied with the tuition provided to you by the instructor within the first lesson, please notify us within 24 hours of the conclusion of your lesson by emailing email@example.com or via our live chat during business hours. In such circumstances we will refund any amount already paid by you for the lesson, to your payment method or Midrive account.
The money back guarantee only applies to a maximum of two hours of the first lesson with the new instructor. For example if the first lesson length is six hours, Midrive will only refund the first two hours of the lesson as part of the first lesson money back guarantee.
Please note, the first lesson money back guarantee only applies if you notify us within 24 hours of the conclusion of your lesson that you are dissatisfied with your instructors tuition during the lesson. Should you notify us outside of the 24-hour period, we will attempt to rematch you with another driving instructor (where possible) to complete your remaining hours.
If your first lesson is not able to proceed due to your not having a valid UK Provisional or if you're intoxicated by alcohol and/or a controlled substance, you will not qualify for a refund.
If you cancel your lesson within 48 hours of the start time of the lesson, you will also no longer qualify for a refund.
Nothing in these Terms affects your statutory rights. Please speak to your local Citizens’ Advice bureau for more information.
Refunds after your first driving lesson
We understand that on occasion things don’t quite work out. We are able to offer every learner a free rematch, so that you can continue your driving lessons with a new instructor.
Should you not wish to continue with another driving instructor sourced via the Midrive platform, you can request a refund for the unused credits on your account providing you contact us within 14 days of the date of your first lesson occuring. Midrive will refund you for any unused hours at the hourly rate paid on your first purchase after the application of any discount or promotional codes. We reserve the right to seek confirmation from your driving instructor before proceeding with any refund.
You can request a refund of any unused hours from a top-up package providing you contact us within 14 days of purchasing the top up.
If you cancel your first lesson within 48 hours of the scheduled start time (defined as a late cancellation) the 14 day period starts on the date the lesson was scheduled to occur.
Outside of the first lesson guarantee, any hours already used to take lessons with a Midrive instructor are strictly non-refundable.
Refunds following a test pass
We will refund any unused hours on your account if you pass before you have used up your full allocation of credits.
All you need to do is send us a scanned copy of your practical driving test pass certificate within 14 days of passing your test. Refunds will typically be processed within 24 hours. All retail refunds take up to a maximum of ten working days to reflect on your bank statement.

No refunds will be issued for lesson credits which have expired.
To be eligible for the unused hours refund you must have booked your driving test through Midrive. Once the practical driving test certificate has been sent to us, we will then cross reference the test with the test booking on the app that will have been input by your instructor. We will not be able to refund any unused hours on the account if your test has not been input by the driving instructor. If you believe your test has not been booked in correctly into the app, please contact our Customer Happiness team.
In the event that you have paid the instructor directly for the test day, we will not be able to refund the unused hours on the account.
You may cancel or re-arrange a lesson without penalty if you confirm with your instructor 48 hours before your lesson begins. If you cancel or attempt to re-arrange the lesson within 48-hours of your lesson starting, you will be charged in full for the lesson at your instructor’s discretion.
You must confirm with your Midrive instructor that your lesson has been cancelled or re-arranged and Midrive itself will not be responsible for communicating any cancellations to your instructor.
There are some occasions where we are unable to help learners get on the road with a driving instructor. On the rare occasion that this occurs, we reserve the right, at our sole discretion, to proactively refund any unused lesson hours, within 14 days of your original purchase. We will of course contact you via email to confirm that this is happening. Our normal refund timescales will apply as described below.
We also reserve the right to refund any learner found to be in breach of our Terms and Conditions or who is found to be acting in a hostile or discriminatory manner.
Processing a refund
Refunds will be processed within 24 hours of your request. This allows us to conduct an appropriate check with your instructor before the refund is processed. All retail refunds take up to a maximum of ten working days to reflect on your bank statement.
We can and will only refund the amount due to the payment method used to make the original transaction. Please note that if your card has expired, the funds will return to your bank account associated with your original debit or credit card.
Our pricing is controlled by a number of factors, including (not all are listed here): demand, average market pricing, and transmission.
We aim for our pricing to be as fair and as accurate as possible, but it is subject to change at any point and we do not offer any guarantee to hold or honour a quote, unless otherwise stated.
How we get paid
Instructors who belong to big schools pay franchise fees so the school are obliged to send them a minimum number of pupils regardless of whether they are recommended by learners!
Midrive instructors pay no franchise fees so we are not obliged to send them any minimum number of learners. Instead, Midrive receive a fixed percentage commission from Driving Instructors for each lesson sale.
Gift cards and vouchers
Our gift cards and vouchers are provided by Midrive Limited via Midrive.com only. On purchasing a gift card you agree to accept the terms and conditions outlined on this page in addition to the following:
- The value of a gift card/voucher can only be redeemed against the cost of a lesson package with Midrive.com - there is no cash alternative.
- Our pricing is subject to change at any point, without prior notice.
- The gift card/voucher recipient must hold a valid UK Provisional Licence in order to take driving lessons through the Midrive platform.
- You may be required to make a top-up payment at the time of redeeming the gift card/voucher. This must be paid at the time of redemption.
- Any subsequent top-up payment that is required will need to be purchased in accordance with the prices on Midrive.com, which are subject to change without prior notice.
- We accept no liability or responsibility to honour a price previously advertised on Midrive.com or any of our products.
- Gift cards/vouchers can only be redeemed by one person and are non-transferable once redeemed.
- The value of a gift card/voucher is valid for a 12-month period from the valid date of purchase. After this time, any available credit will become void.
- Midrive and our agents reserve the right to decline the attempt to redeem a gift card, which we believe to be false, replicated, or being used to deceive or commit fraud.
- Should we believe an account to be fraudulent we reserve the right to report the account holder to the relevant legal authority.
We reserve the right to close any account and seek payment from an alternative method if we suspect or are informed of a gift card being redeemed or obtained to commit fraud.
Delivery of digital Gift Voucher codes
Gift Voucher codes will be delivered to the purchaser of Midrive Gift Voucher codes via the email address given when the purchase was made on Midrive.com.
Midrive accepts no liability for technical issues outside of its control in relation to the sending of Gift Voucher codes by email. It is the Gift Voucher code purchaser's responsibility to ensure that they have entered a valid and working email address to Midrive.
If the email containing details of the Gift Voucher code is undelivered, Midrive will endeavour to contact any Gift Voucher code purchaser through alternative means if those have been provided. However, it may take up to 28 working days.
Gift card refunds:
Our usual refund policy applies to all purchases made with Midrive, including gift cards, unless otherwise stated. You agree to these terms when you purchase with us.
Promotions and discount codes
There are occasions that we run and offer promotions, including but not limited to personalised discount codes. All of our promotions and discount codes are subject to our standard Terms and Conditions, in addition to the terms below:
- All discounts or codes are applicable to first time purchases with Midrive only, unless otherwise specifically stated.
- All discounts and codes must be applied before the completion of the sign up process, and cannot be applied retroactively.
- New customers are permitted to use only one discount per purchase. Subsequent purchases will not be eligible for any discounts, unless otherwise specifically stated.
- We reserve the right to withdraw our services if we believe a promotional code has been inappropriately or illegally acquired and/or used.
- On occasions where multiple accounts are created for the purpose of redeeming and/or using the same promotion for the same customer, we will only honour the discount on the first purchase and on one account. All subsequent purchases and/or accounts will require a top-up purchase. Failing that, our services will be withdrawn and the balance refunded.
- Our promotions and discounts run for limited periods of time, specified on the adverts, coupons or leaflets.
- We do not offer any guarantee or intention to honour any promotional offer or discount after the expiry date.
- We only provide promotions via Midrive.com and our apps/products to the email address you registered with or through selected 3rd party websites. We do not accept any responsibility or liability for any promotions offered by third party websites and reserve the right to not honour any promotion advertised on such sites if they are acting without the express permission of Midrive Limited.
- A refund or cancellation where a promotional code has been used will invalidate the use of the code by that customer and/or account and they will not be eligible for any first time customer promotion in the future.
- We reserve the right, where we believe necessary, to undertake all reasonable action to protect ourselves against fraud and suspicious or invalid redemptions, including but not limited to seeking further verification as to the identity of a customer.
Nothing in these Terms affects your statutory rights. Please speak to your local Citizens’ Advice bureau for more information.
